The owner of THEMO.EE (hereafter Online Shop) is OÜ Smart Load Solutions (registry code 12764599), located at Masti 17, Pirita, Tallinn, 11911, Estonia
VALIDITY OF THE SALES AGREEMENT, COMMODITY AND PRICE INFORMATION
The terms of sale apply to purchases of goods from the Web Store.
The prices of the products sold in the online store are indicated with the products. The delivery fee is added to the price.
The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be shown to the buyer when placing the order.
Product information is available in the Online Store directly at the item.
You have to add the desired products to the shopping cart. To place an order, fill in the required fields and choose the appropriate delivery method. The amount of the charge will then be displayed, which can be paid via bank link or other payment solution.
The Agreement shall enter into force upon receipt of the amount due into the bank account of the Online Shop.
The Online Shop is responsible for processing any personal data, the Online Shop forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
The delivery partners of the Online shop are Ominva and Itella Smartpost. The available payment methods are Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay and card payments: Visa / Mastercard.
If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the buyer shall be informed at the earliest opportunity and the money paid (incl. Delivery costs) shall be refunded immediately, but not later than within 14 days of dispatch.
The goods are shipped to the following countries: Estonia, Finland, Latvia, Lithuania. Orders made outiside from these countries must be specifically agreed with the web store owner.
The cost of shipping the goods is borne by the buyer and the corresponding price information is displayed next to the shipping method.
Domestic shipments generally arrive at the destination specified by the buyer within 3-7 business days of the entry into force of the contract of sale.
In exceptional cases, delivery may take place up to 45 calendar days.
RIGHT OF WITHDRAWAL
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered merchandise may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the merchandise as permitted for testing at the physical store.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Web Store shall have the right to reduce the refundable amount in proportion to the value of the goods.
To return the item, you must submit a withdrawal form, the form of which can be found here: withdrawal form and send it to email@example.com within 14 days of receipt of the item.
The cost of returning the goods shall be borne by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to the order (eg, a wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or provide proof that he has delivered the goods to the carrier within the said period.
The online store will return the returned item to the buyer immediately, but not later than 14 days after receipt of the notice of withdrawal, any fees received from the buyer under the contract.
The online shop may refuse to refund until the item that is the subject of the contract has been returned or the buyer has provided proof of return, whichever is earlier.
If the buyer has explicitly opted for a delivery method other than the cheapest standard delivery method offered by the Web Store, the Web Store does not have to reimburse the consumer for any cost that exceeds the cost of the standard delivery method.
The online shop has the right to withdraw from the sale and to reclaim the goods from the buyer if the price of the goods in the online shop is mistakenly marked below the market price of the goods.
The Supplier may extend the right to withdraw period to a period of 100 days from receipt of the devices.
This extended right to withdraw period and the refund of any amount for the devices shall further be subject to the devices having been connected to a heating system for a continuous period of at least 30 days.
RIGHT OF CLAIM
The Webshop shall be liable for any lack of conformity or defect in the goods sold to the Purchaser which already existed at the time of delivery and which will become apparent within two years of delivery of the goods to the Purchaser. Within this first six months of delivery of the item to the buyer, the defect is presumed to have existed at the time of delivery. It is the Web Store's responsibility to rebut this assumption.
The buyer has the right to contact the online store within two months of the date of the defect, by sending an email to firstname.lastname@example.org
The webshop is not responsible for any defects that occur after delivery of the goods to the buyer.
If any item purchased from the Web Store has defects for which the Web Store is responsible, the Web Store will repair or replace the defective item. If the goods cannot be repaired or replaced, the Web Store shall refund to the Purchaser all the fees incurred in the contract of sale.
The online shop responds to a consumer complaint in writing or in a format that can be reproduced in writing within 15 days.
DIRECT MARKETING AND PROCESSING OF PERSONAL DATA
The Web Store will only use the personal information (including name, phone number, address, email address, bank details) entered by the buyer to process the order and send the goods to the buyer. The online store transmits personal information to the transport companies in order to deliver the goods.
